Terms of Service

The deal, in plain English.

The short version: IndexMark makes your business easier for AI assistants and search engines to read. We do that work for you. We can't promise a specific ranking or that any assistant will recommend you — no one honestly can — you can cancel a monthly plan anytime, and if we haven't done the work yet, you get your money back.

1. Who we are

IndexMark is a service operated by Fulcrum Enterprises LLC ("we", "us"), a Florida limited liability company. By using our website, the free scan, or a paid plan, you agree to these terms. If you don't agree, please don't use the service. You can reach us any time at [email protected] or at the postal address at the bottom of this page.

2. What IndexMark does

We read the public pages of your website the way an AI assistant does, tell you what those systems can and can't understand about your business, and — on a paid plan — create and maintain the machine-readable information (structured data and related files) that helps them read you correctly. This is a service, not a physical product: there is nothing to ship.

The machine-readable files we create for your business are yours to use for your business. The IndexMark software, scanner, brand, and methods remain ours. On hosted plans, we host those files for you while your plan is active; if you cancel, we'll help you take a copy.

8. Fair use

Use IndexMark only for websites and businesses you own or are authorized to represent. Don't use it to scan sites you have no relationship with at scale, to break the law, or to interfere with the service. We may suspend or end an account that does, and we'll refund any unused paid period if we do.

9. Where we can work

IndexMark is sold and operated from the United States and is intended for businesses in the United States. We don't currently sell to consumers, to anyone under 18, or into any country subject to US sanctions or export restrictions. If you use the service from elsewhere, you're responsible for whether that's allowed where you are.

10. Security

Our site is served over encrypted HTTPS. Card details are entered on Stripe's own payment page and are handled by Stripe, a PCI Service Provider Level 1 processor — we never receive, see, or store your full card number. We keep your business records on access-controlled servers and give access only to people who need it to do the work. No system is perfectly secure, but we will tell you promptly if something happens that affects your information.

11. The service is provided "as is"

We work hard to be accurate and useful, but the service is provided as is, without warranties. To the extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential losses, including lost business or lost rankings.

12. Changes to these terms

We may update these terms. If a change materially affects you, we'll email you at least 30 days beforehand, and the date at the top of this page will always tell you when it last changed. Carrying on using the service after a change means you accept it; if you'd rather not, cancel and we'll refund any unused paid period.

13. Governing law

These terms are governed by the laws of the State of Florida, USA, and any dispute will be handled by the state or federal courts serving Citrus County, Florida.
