1. Who we are
IndexMark is a service operated by Fulcrum Enterprises LLC ("we", "us"), a Florida limited liability company. By using our website, the free scan, or a paid plan, you agree to these terms. If you don't agree, please don't use the service. You can reach us any time at [email protected] or at the postal address at the bottom of this page.
2. What IndexMark does
We read the public pages of your website the way an AI assistant does, tell you what those systems can and can't understand about your business, and — on a paid plan — create and maintain the machine-readable information (structured data and related files) that helps them read you correctly. This is a service, not a physical product: there is nothing to ship.
3. What we can and can't promise
- We can make your business information readable to AI assistants and search engines, and tell you plainly what we found and what we changed.
- We can't guarantee that any AI assistant or search engine will recommend, rank, list, or mention your business, or send you customers. Those systems are controlled by other companies and change constantly. A readiness score is a screening signal, not a promise of placement.
- Any statistics or examples on our site are illustrations, not a forecast of your results.
4. Plans, billing, and prices
- All prices are in US dollars (USD) and all charges are made in USD.
- Paid plans are billed in advance and renew automatically — monthly plans every month, annual plans every year — until you cancel. We charge the card you gave us at signup.
- Payments are handled by Stripe. We never see or store your full card number.
- Prices are shown on our pricing page and may change with at least 30 days' notice by email. A change never affects a period you have already paid for.
- The One-time fix is a single charge for a single piece of work, with no ongoing hosting, monitoring or renewal.
5. When the work happens
- The free scan runs immediately and takes about a minute.
- On a paid plan we begin work within 3 business days of signup and have your first build live within 15 business days. These are the outside limits, not the target — most are finished well before that, and if we're ever going to miss one we'll tell you before the date, not after.
- Managed and Starter plans then re-check your site every month for as long as the plan is active, and we email you a plain-English report.
- Nothing is shipped and there is nothing to return — this is a service delivered online.
6. Refunds and cancellation
- Cancel any time. Email [email protected] and say you want to cancel — that's all it takes. Your plan stays active through the period you've already paid for and does not renew after that.
- Full refund before we start. If you cancel before we've begun your first build, we refund you in full.
- 14 days to change your mind about the first build. The clock starts when your first build goes live — not when you paid — so you always get a full 14 days with the finished work in front of you. Not happy? Tell us and we'll refund that payment in full. We'd rather fix it, but we won't argue.
- After that, monthly plans are not refunded for a period already served — you simply cancel and it doesn't renew. For annual plans we refund the unused whole months on request.
- The One-time fix is refundable in full until we start the work, and not once the files have been delivered to you.
- If we can't deliver what we promised, you get your money back. That's not a policy we bury.
- Refunds go back to the card you paid with and normally appear within 5–10 business days, depending on your bank.
- Something wrong with a charge? Please email us first — we can almost always sort it out faster than a bank dispute can.
7. Who owns what
The machine-readable files we create for your business are yours to use for your business. The IndexMark software, scanner, brand, and methods remain ours. On hosted plans, we host those files for you while your plan is active; if you cancel, we'll help you take a copy.
8. Fair use
Use IndexMark only for websites and businesses you own or are authorized to represent. Don't use it to scan sites you have no relationship with at scale, to break the law, or to interfere with the service. We may suspend or end an account that does, and we'll refund any unused paid period if we do.
9. Where we can work
IndexMark is sold and operated from the United States and is intended for businesses in the United States. We don't currently sell to consumers, to anyone under 18, or into any country subject to US sanctions or export restrictions. If you use the service from elsewhere, you're responsible for whether that's allowed where you are.
10. Security
Our site is served over encrypted HTTPS. Card details are entered on Stripe's own payment page and are handled by Stripe, a PCI Service Provider Level 1 processor — we never receive, see, or store your full card number. We keep your business records on access-controlled servers and give access only to people who need it to do the work. No system is perfectly secure, but we will tell you promptly if something happens that affects your information.
11. The service is provided "as is"
We work hard to be accurate and useful, but the service is provided as is, without warranties. To the extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential losses, including lost business or lost rankings.
12. Changes to these terms
We may update these terms. If a change materially affects you, we'll email you at least 30 days beforehand, and the date at the top of this page will always tell you when it last changed. Carrying on using the service after a change means you accept it; if you'd rather not, cancel and we'll refund any unused paid period.
13. Governing law
These terms are governed by the laws of the State of Florida, USA, and any dispute will be handled by the state or federal courts serving Citrus County, Florida.
